This privacy policy applies to services from 3DVista Espa ña SL (“3DVista ”, “we ”, “our ”, “us ”) and  has been compiled to better serve those who are concerned with how their “Personal Identifiable Information ”(PII) is being used online. Please read our Privacy Policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personal Identifiable Information when you use and access our website(s),  client software solutions , hosted or cloud based solutions, mobile solutions (Apps), as well as any related support and maintenance services (hereinafter referred to as “Services ”). For the purposes of EU data protection laws ( " Data Protection Legislation " ), 3DVista is data controller (i.e., the company who is responsible for, and controls the processing of, your personal data).

By using our Service you understand and agree that we are providing a platform for you to create and post content, including photos, videos, virtual tours, text information, comments and other materials ("User Content "), to the Service and to share User Content publicly. This means that other Users may search for, see, use, or share any of your User Content that you make publicly available through the Service, consistent with the terms and conditions of this Privacy Policy.

Our Policy applies to all visitors, users, and others who access the Service ("Users "). By visiting our website or using any of our services, including but not limited to our software and App(s), you agree to be bound by the terms and conditions of this Privacy Policy. If you do not agree, please do not use or access our Site, Software, App or other services.  By accepting the Privacy Policy, you expressly consent to our use and disclosure of your personal information in accordance with this Privacy Policy.  This Privacy Policy is incorporated into and subject to the terms of the 3DVista Terms of Service. It is effective upon acceptance in registration for new registering users, and is otherwise effective on May 25th, 2018 for all users.

We may collect information about your use of these feature, such as content “liked ”and address information in Google Maps. In addition, when you see or interact with these buttons, tools, or content, or view a 3DVista web page or app containing them, some information from your browser may automatically be sent to the other company. Please read that company ’s privacy policy for more information. Social media features are either hosted by a third party or hosted directly on our Services. Your interactions with these features are governed by the privacy policy of the company providing it.

2. HOW WE USE YOUR INFORMATION AND WHAT ARE THE LEGAL BASES FOR THESE USES?

We will only use your personal data when the law allows us to.   Under the GDPR, every data processing activity, performed as a controller or processor, needs to rely on a legal basis.   The GDPR recognizes a total of six legal bases for processing EU individuals ’personal data (in the GDPR, EU individuals are referred to as “data subjects ”). We will not rent or sell your information to third parties outside 3DVista (or the group of companies of which 3DVista is a part) without your consent, except as noted in this Policy.

What happens in the event of a change of control: If we sell or otherwise transfer part or the whole of 3DVista or our assets to another organization (e.g., in the course of a transaction like a merger, acquisition, bankruptcy, dissolution, liquidation), your information such as name and email address, User Content and any other information collected through the Service may be among the items sold or transferred.

Responding to legal requests and preventing harm: We may access, preserve and share your information in response to a legal request (like a search warrant, court order or subpoena) if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of the United States where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards. However, despite our efforts, no security controls are 100% effective and 3DVista cannot ensure or warrant the security of your personal information.   We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site.

Sensitive and private data exchange between the Site and its Users happens over a SSL secured communication channel and is encrypted and protected with digital signatures.

We take each request seriously. We will comply with your request to the extent required by applicable law. We will not be able to respond to a request if we no longer hold your Personal Data. If you feel that you have not received a satisfactory response from us, you may consult with the data protection authority in your country.

For your protection, we may need to verify your identity before responding to your request, such as verifying that the email address from which you send the request matches your email address that we have on file. If we no longer need to process Personal Data about you in order to provide our Services or our Sites, we will not maintain, acquire or process additional information in order to identify you for the purpose of responding to your request.
